Hiring foreign nationals in 2025: new rules
From 1 June this year, employers wishing to hire foreign nationals must meet new requirements introduced by the Act of 20 March 2025 on the Conditions for Entrusting Work to Foreign Nationals in the Republic of Poland.
The Act introduced, among other things:
- A requirement to conclude a written contract with the foreign national, except where they serve as a management board member, representative of a limited partnership or partnership limited by shares, or holder of a commercial power of attorney;
- A requirement to present the contract's contents in writing in a version the foreign national understands, where the contract is in Polish and the person does not speak Polish;
- A requirement for a sworn translator to translate the contract into Polish if it was prepared in a foreign language;
- An obligation for entities entrusting work to send copies of contracts with foreign nationals to the relevant authorities through a dedicated electronic system;
- Simplified employment legalisation procedures, including abolition of the labour market test, which required checking the local market to confirm that no unemployed Polish citizens met the job requirements;
- Stricter sanctions for irregularities in employing foreign nationals;
- Digitisation of procedures for obtaining work permits.

Hiring foreign nationals: how to do it in 2025?
Where should you begin under the new rules?
Under Article 4(2) of the Act mentioned above, before work begins, every entity entrusting work must require the foreign national to present a valid document authorising residence in Poland.
A copy must then be retained throughout employment and for two years from the end of the calendar year in which the legal relationship underlying employment ended or expired, unless a longer documentation retention period applies to the specific case.
Has the person presented a document authorising lawful residence in Poland and allowed you to copy it?
Then, as employer, you must use the dedicated electronic system to apply for a work permit or register a declaration of entrusting work.
Remember that neither a work permit nor a declaration confirms employment in your company! You must additionally conclude a written employment or civil-law contract incorporating the conditions declared in the permit or declaration.
Next, remember the new obligation to send the competent authorities a copy of the signed employment or civil-law contract through the electronic system.
The employer must then provide appropriate working conditions, including legally compliant remuneration, and continuously monitor residence and work legality.
