An employee may start a business, or a business owner may take an employed role. Receiving income from both creates overlapping insurance titles. The consequences differ for social insurance, health insurance and voluntary sickness insurance.

Employment pay is the key starting point

A business owner generally has retirement, disability and accident insurance obligations. An important exception applies when employment provides the relevant monthly contribution base at least at the statutory minimum wage. The source article gives the 2026 minimum as PLN 4,806 gross.

When the employment condition is met, social insurance from the business is generally no longer compulsory. Where it is not met, business contributions may remain compulsory. Check the actual contribution rules, including periods of absence or other exceptional circumstances, rather than only the cash paid in a particular month.

Working part-time does not by itself prevent the exception. Pay from more than one employment relationship may be relevant when assessing the monthly minimum.

Health insurance is assessed separately

Employment social insurance relief does not normally remove the business health contribution. The employer handles the employment contribution, while the business owner accounts for the contribution associated with the business.

The business calculation depends on the tax method. Specific statutory health contribution exemptions should be checked separately; employment alone is not a general exemption.

Voluntary sickness insurance

Employment carries compulsory sickness insurance. When retirement and disability insurance from the business are not compulsory because of the overlapping employment title, the entrepreneur cannot simply add voluntary business sickness insurance.

This is different from choosing whether to pay voluntary retirement and disability contributions. Paying an additional amount does not automatically create a second sickness benefit entitlement.

What to check in practice

Confirm the employment contribution base, applicable minimum, business tax method and correct ZUS registration. Changes in employment or pay can change the business position, so notify the person preparing your settlements promptly.
