Every taxpayer using the tax scale encounters a concept directly affecting the tax due. The tax-free allowance sets the income limit below which personal income tax is not payable. Many questions surround this amount, as increasing it has been debated for several years. However, specific unchanged rules apply to 2026 settlements and are worth knowing before filing a return. Below, TaxCoach experts explain its amount, practical operation and who qualifies.
The tax-free allowance — what is it and where does it come from?
Polish legislation contains no literal definition of this concept, as the legislator uses the term tax-reducing amount. This gives the economic meaning of the tax-free allowance: the income level up to which tax is zero. The mechanism is simple: income within the statutory limit carries no tax. Above it, the tax-reducing amount lowers the charge by a fixed sum, so higher earners benefit too. Asking how much the tax-free allowance is therefore comes down to the tax-reducing amount specified in the PIT Act.
How much is the tax-free allowance in 2026?
For 2026 settlements, the 2026 tax-free allowance is PLN 30,000, remaining at the level established on 1 January 2022. The tax-reducing amount is PLN 3,600 annually, since 12% of PLN 30,000 gives this figure. The monthly tax-free allowance translates into PLN 300 by which the remitter reduces the PIT advance. This amount applies to the taxpayer in total, not separately to every contract. People with annual income up to PLN 30,000 therefore pay no tax, while others pay only on the excess.
The tax-free allowance and tax scale brackets
The 2026 tax scale has two rates: 12% for the tax calculation base up to PLN 120,000 and 32% on the excess. The tax-free allowance operates within the first bracket, where calculated tax is reduced by the tax-reducing amount. After crossing the threshold, this principle remains unchanged, but every additional zloty carries the higher rate. This progressive structure means higher earners bear a proportionately greater tax burden. Knowing both rates helps estimate the actual burden before filing.
Who qualifies for the tax-free amount and who does not?
Only taxpayers using the tax scale, the general rules, benefit from the tax-free amount. This follows from the legal structure, linking the tax-reducing amount to this taxation method rather than each income source individually. Much revenue taxed under other rules therefore falls outside this preference. Check which taxation methods do not qualify to avoid incorrect assumptions. The rule does not cover, among others:
- flat-rate tax reported on PIT-36L,
- lump-sum tax on registered revenue reported on PIT-28,
- tax on capital income reported on PIT-38,
- tax on real estate sale revenue declared on PIT-39,
- tax-exempt revenue and small contracts up to PLN 200 taxed at a lump-sum rate.
This list shows that asking about the tax-free allowance first requires establishing the settlement method. Business owners often combine different revenue sources, so analysing the whole situation may be necessary before choosing taxation.

Professional accounting services help match the settlement method to actual income and reduce error risks. Such support is particularly valuable when combining employment with additional business activity. The taxpayer then consciously uses available preferences instead of losing them through an ill-considered choice.
The monthly tax-free allowance and the PIT-2 declaration
For monthly advance reductions to apply during the year, employees should submit a PIT-2 declaration to the remitter. The employer then deducts PLN 300 from the monthly advance, making monthly pay slightly higher. Where income comes from several remitters, the tax-reducing amount can be divided between at most three. Contractors can also use this option to receive current remuneration with lower advances. Failure to submit PIT-2 does not mean losing the preference: the unused tax-free allowance is settled in the annual return.
If in doubt, consulting a tax adviser who assesses the taxpayer’s individual situation may help.
Can the tax-free allowance exceed PLN 30,000?
The statutory tax-free allowance is the same for everyone, but certain mechanisms allow wider tax reductions. Spouses filing jointly calculate tax on half their combined income, creating an effect similar to a doubled allowance of PLN 60,000. This does not increase the statutory limit; it follows from the tax calculation method for two taxpayers. Single parents also benefit from a doubled allowance under similar statutory rules. Young taxpayers under 26 combine young people’s relief with the allowance, leaving a total of over PLN 115,000 of revenue untaxed.
The PLN 30,000 figure has long been politically debated, as raising the tax-free allowance to PLN 60,000 was a prominent election promise. The submitted bill envisaged gradual increases to PLN 35,000, then PLN 45,000 and ultimately PLN 60,000. However, the finance ministry says the current budget situation leaves no room for tax cuts, so the timing remains unspecified. The existing PLN 30,000 limit therefore still applies to 2026 settlements.

Summary
FAQ — frequently asked questions
Does the tax-free allowance cover an employment contract?
The tax-free amount for employees does not depend on the type of contract covered by the scale, so it is PLN 30,000 annually. Employers reduce monthly advances by PLN 300 if employees submit PIT-2. After changing employer during the year, submitting a new declaration is advisable, as the previous remitter stops applying the reduction. Annual income within the limit results in zero income tax. Otherwise, the tax-reducing amount lowers only part of the tax due.
How does the tax-free allowance work for a mandate contract?
The answer is the same as for employment, as both fall within the tax scale. Contractors can also submit PIT-2, allowing the principal to reduce monthly advances by the available share of the tax-reducing amount. Small contracts with remuneration not exceeding PLN 200 are taxed at a lump-sum rate and do not qualify. Final settlement occurs in the annual return combining all scale-taxed income. It is therefore worth collecting revenue information throughout the year.
What is Poland’s tax-free allowance for pensioners?
Retirement and disability pensioners whose benefits are scale-taxed qualify under the same rules as other taxpayers. Annual benefits up to PLN 30,000 therefore carry no income tax. The pension-paying authority acts as remitter and applies the tax-reducing amount when calculating advances. If total income exceeds the limit, tax applies only to the excess. Additional revenue, for example employment income, combines with the benefit under one annual limit.
