Some entrepreneurs save money by declining voluntary sickness insurance, then consider joining when their health deteriorates. But payment of the first contribution does not normally create an immediate right to sickness benefit. The waiting period and contribution arrears both matter.

Voluntary insurance and the waiting period

For eligible self-employed people, sickness insurance is voluntary, unlike the generally mandatory health and relevant social insurance. Choosing not to join can mean no sickness-insurance benefit if illness prevents work.

Under Article 4(1) of the Sickness and Maternity Benefits Act, entitlement normally begins after:

The second rule generally applies to entrepreneurs joining voluntarily. Under Article 4(2), previous periods can count if the break does not exceed 30 days, or if a qualifying break results from childcare leave, unpaid leave or active military service by a non-professional soldier.

Can entitlement arise without waiting?

Statutory exceptions include qualifying graduates who join within 90 days after completing the relevant education, former MPs or senators joining within 90 days after their term ends, and incapacity caused by an accident on the way to or from work.

The precise conditions must be met; the fact that a person runs a business does not itself remove the waiting period.

Contribution arrears and benefit payment

Under Article 2a, an entrepreneur’s social-insurance debt exceeding 1% of the minimum wage on the date entitlement arises can block payment. The rule also concerns other specified cash benefits, including rehabilitation, maternity and care benefits.

If the entire debt is repaid within six months from the relevant entitlement date, benefit can be paid for the eligible period of incapacity, provided the other conditions are met. Repayment after that period generally permits benefit only for the remaining period from full repayment, rather than restoring the expired claim for the earlier period.

Late payment is not the same as loss of insurance

The original introduction referred to uninterrupted and timely contributions. Since the 2022 changes, paying a contribution late does not itself automatically end voluntary sickness insurance as under the earlier approach. Insurance coverage, the waiting period and the arrears-related block on benefits must be checked separately.

Before relying on protection, verify the effective registration date, previous insurance periods and the balance on your ZUS account. Keep the records needed to establish entitlement.

For most voluntarily insured entrepreneurs, protection for ordinary sickness starts after the 90-day waiting period, unless earlier periods or an exception apply. Check contribution debt as well as coverage: arrears can block payment even when the waiting period is complete. Joining only once illness is imminent may therefore be too late.
