Buying a new smartphone with an invoice offers substantial tax savings, but on one condition: you must prove its connection with your business. We explain how to account correctly for a business phone purchase, how much you can recover, and whether tax officials can check your call records!

A phone for a sole proprietorship as a tax-deductible cost

The Polish tax system has no closed list of items that can or cannot be bought “for the business”. The principle in Article 22(1) of the PIT Act applies.

Costs include all expenditure incurred to earn revenue or preserve or secure its source.

When buying a business phone, you must demonstrate a rational connection between the expense and your activity. This is relatively straightforward today. A smartphone is no longer just for calls: it is a payment terminal, document scanner, and a tool for banking, email and social media marketing.

If you run an online shop, construction company, consultancy or IT services, the cause-and-effect connection is obvious. Without contact with the outside world, you have no customers. The tax office rarely challenges the phone purchase itself if the business requires communication even minimally. Problems may arise where the activity does not require mobility at all, but the taxpayer buys the most expensive model available.

All expenses related to protecting and using the equipment are tax-deductible costs. Accessories such as a case, protective film, tempered glass or charger are fully justified: they protect business assets from damage and ensure work continuity.

A business phone – how much can you deduct?

A phone purchase by a business owner can reduce tax burdens. The mechanism works in two ways: reducing income tax and recovering VAT. Your benefit depends on your taxation method and taxpayer status.

If you are an active VAT taxpayer and the phone will be used exclusively for taxable activities, you can deduct 100% VAT. For mixed business and private use, deduction should be proportional.

Use common sense, however. If an invoice covers two phones and you employ no one, the tax authorities may ask who uses the second. If they prove one is exclusively private, for example used by a family member not employed by the company, VAT deduction is lost and recognising the expense as a PIT cost will be considered an attempt to underpay tax.

Phone depreciation – one-off or straight-line? Limits applicable in 2026

A sole proprietor can include a phone purchase in tax-deductible costs. The net invoice amount reduces the income used to calculate tax. This applies to entrepreneurs taxed under the general tax scale or flat-rate income tax.

Cost recognition depends on the equipment’s value:

Important! With lump-sum tax on recorded revenue, you pay tax on revenue rather than income and cannot reduce tax by the phone’s purchase costs. This does not mean no benefit: lump-sum taxpayers still have the right to deduct VAT under the general rules.

How do you finance a business phone? Cash, instalments and leasing versus when costs are recognised

The payment method affects when and what you record. Entrepreneurs most often face a choice between an invoice paid immediately and external financing.

Purchasing with cash or bank transfer

This is the simplest situation. In KPiR, the cost is recorded according to the invoice issue date. With lump-sum tax, you do not deduct PIT costs, but can still account for VAT if actively registered. Remember the cash payment limit between entrepreneurs: in 2026 it remains PLN 15,000 gross. Smartphones rarely exceed this amount, but if buying several devices, a transfer from the business account is safer.

A business phone on instalments

This is popular in electronics stores. Buying a business phone on instalments gives you an invoice for the equipment’s full value on the purchase date. You record this immediately as a cost or fixed asset.

Watch the interest! Promotional “0% instalments” repay only principal without additional financing costs. With an interest-bearing loan, each instalment includes principal and interest. Interest becomes tax-deductible only when actually paid, under the cash method, not when the repayment schedule is issued. Each instalment therefore requires separate recording of its interest portion.

Leasing a business phone

Operating leasing is the most common choice. The phone formally belongs to the leasing company and the entrepreneur merely uses it. Each monthly invoice is recognised fully as a tax-deductible cost, and VAT is deducted as it arises. The phone can be bought after the contract ends. Financial leasing is less common: the phone immediately becomes a depreciable business fixed asset, and only the interest portion of instalments is a cost. All VAT must be paid upfront in this variant.

Long-term rental is also increasingly popular. The entrepreneur pays for using the equipment, and the rental service invoice is a business cost. After the contract ends, there are usually three options: returning the device, exchanging it for a newer model or buying it at the proposed price.

Business phone expenditure can be recognised as a cost regardless of the chosen purchase financing or arrangements with the operator. Both subscription invoices and invoices documenting prepaid top-ups are valid tax costs. Proof of purchase issued to the business is always required. If collecting small invoices is troublesome, our professional accounting services will help organise the documentation and ensure you lose none of your entitled deductions!

How often can you buy a business phone, and how many can you have?

The law sets no quantity or time limit. No article specifies how often you can buy a business phone. In IT, marketing or trade, replacing a phone every year or two is fully justified by technological advances: older models may not support required apps or may work too slowly. However, if you run a one-person car workshop and buy a third phone in a quarter, a tax inspector will certainly ask why.

Can you therefore have two or more business phones? Yes. You can argue that different numbers serve customer contacts and contacts with the bank and accountants. All phones must genuinely be in the business.

A business phone – is it worthwhile?

Buying a business phone is one of the simplest and safest ways to optimise sole proprietorship costs. It allows both VAT recovery and an effective income tax reduction, making a modern smartphone significantly cheaper than its shelf price. Efficient equipment is not just a tax saving, but above all greater working comfort and better customer communication.

To avoid errors recording high-value equipment or accounting for complex leasing contracts, consult experts. An experienced accounting firm will record the invoice correctly and advise whether one-off depreciation or another financing model is better for you.

Summary

Does VAT deduction on a business phone also apply to used equipment?

Yes, a used phone can also be a business cost and, if you are an active VAT taxpayer, VAT can be deducted, provided it is used in the business and you receive an invoice issued to the company, for example from a second-hand shop, retailer or seller of equipment after leasing. Buying from a private individual without a business invoice does not allow VAT deduction.

My business phone was stolen or destroyed. Must I correct costs and repay VAT?

No, provided the event was accidental and not your fault. Tax authorities accept that losing a fixed asset or equipment through theft does not remove entitlement to costs and deducted VAT. However, keep proper documentation, preferably a police theft report or equipment destruction report. Without evidence, an official may consider the phone transferred for private use or sold off the books.

Can extra services on an operator’s invoice, such as Netflix or Spotify, be included in costs?

Tax offices usually challenge streaming service expenses as unrelated to business, treating them as personal expenditure. Creative, marketing or cultural industries may be exceptions where access to popular culture is necessary for creating content or monitoring trends, but you must be prepared to justify this to the auditing authority.

Is selling a phone bought for the business legal?

Yes, but the sale constitutes business revenue. Document it with a sales invoice adding 23% VAT. Record the net amount in column 8 of KPiR as “other revenue”. If the phone appeared in the fixed asset register, remember to formally remove it after disposal.
