Under Article 41(12) of the VAT Act, certain construction services may, in specific circumstances, qualify for a reduced VAT rate. The 8% rate can significantly affect project costs. It is therefore useful to know when it applies. This guide explains the conditions for 8% VAT and gives examples where the reduced rate does not apply.

When can the reduced 8% VAT rate be applied?

The reduced 8% VAT rate may apply to:

  1. The supply or construction of buildings or parts of buildings included in the social housing programme.

  2. Renovation, modernisation, thermal upgrading, reconstruction and maintenance work on those buildings or their parts.

The 8% rate may also be applied to maintenance services involving:

  1. Residential buildings or their parts, excluding commercial premises.

  2. Residential units in non-residential buildings classified in section 12 of the Polish Classification of Construction Objects (PKOB).

Which buildings are included in the social housing programme?

They include:

  1. Buildings for permanent residence classified in section 11 of PKOB.

  2. Residential units in non-residential buildings classified in section 12 of PKOB.

  3. Buildings classified in PKOB class ex 1264 that are healthcare institutions providing accommodation with medical and nursing care.

Remember that single-family residential buildings with usable floor area exceeding 300 m² and residential units exceeding 150 m² do not qualify for the reduced VAT rate.

Examples of negative tax rulings on the reduced VAT rate:

Example 1: Maintaining fencing and playground elements

A civil partnership maintained and repaired fencing, benches and playground elements around buildings included in the social housing programme. Although the work maintained elements associated with qualifying buildings, the Directors of the Tax Chambers in Bydgoszcz (individual ruling of 15 November 2012, ref. ITPP1/443-858/10/TS) and Warsaw (ruling of 1 December 2011, ref. IPPP3/443-1172/11-4/k.c.) held that the rate was 23%, as the work concerned accompanying infrastructure rather than the buildings themselves.

Example 2: Repair and maintenance of water and sewage installations

A taxpayer repaired and maintained water and sewage infrastructure at buildings included in the social housing programme, including storm drains and water supply equipment. The Director of the Tax Chamber in Łódź (ruling of 29 February 2012, ref. IPTPP1/443-1017/11-4/AK) held that the work's nature and location outside the building meant the applicable VAT rate was 23%.

Example 3: Technical inspection of gas and central-heating installations

A taxpayer undertook technical inspections of social-housing buildings, including central heating and gas installations. Although the aim was to keep the installations in good condition, the Directors of the Tax Chambers in Katowice (ruling of 12 May 2011, ref. IBPP2/443-146/11/ICz) and Bydgoszcz (ruling of 18 November 2011, ref. ITPP2/443-1191/11/AK) ruled that these did not qualify for 8% VAT because there was no physical intervention in the building.

Example 4: Chimney maintenance

A taxpayer maintained chimney flues in social-housing buildings, including cleaning flues and repairing plaster. The Director of the Tax Chamber in Katowice (ruling of 12 May 2011, ref. IBPP2/443-146/11/ICz) held that flue cleaning did not qualify for 8% VAT, but physical plaster repairs could.

Example 5: Gas boiler inspection and maintenance

A taxpayer inspected and maintained gas boilers in buildings for permanent residence. The work included technical checks, cleaning, component maintenance and adjustments. The Director of the National Tax Information (ruling of 31 October 2019, ref. 0111-KDIB3-1.4012.567.2019.2.ICZ) held that boiler inspections could not use 8% VAT, but boiler maintenance could, provided the value of goods did not exceed 50% of the maintenance work's value.

How can you be sure of the correct VAT rate?

It is advisable to seek an individual tax ruling to be certain of the appropriate VAT rate and avoid potential problems with tax authorities.

The full rules on the reduced VAT rate can be found here in the Minister of Finance's Regulation of 23 December 2013.
